These terms and conditions (the “Terms”) are the terms which apply when you access the website http://www.beautylab.co.uk (the “Website”) or place orders to purchase any of the products made available to you on the Website. Any reference to “we”/”us”/”our” in these Terms is a reference to Gerrard International Limited (sole UK distributor for BeautyLab London) and any reference to “you”/”your” means you, the user of the Website. By accessing this Website or when you place orders to purchase any of the products on the Website you agree to be bound by these Terms. We recommend that you keep a copy of these Terms for future reference. These Terms are only available in the English language.

 

Changes to Terms

We reserve the right to add, change, modify or delete portions of these Terms at any time without notice including for legal, regulatory or security reasons. If we do this, we will post the changes to these Website terms on this page and will indicate at the top of this page the date these terms were last revised. It is your responsibility to check the Terms for changes. If you do not agree to any of the Terms then you can simply stop using the Website at any time. The ordering process and order confirmation

Your order via our online store constitutes an offer to us to buy the products you select from the Website. All orders are subject to availability and to acceptance by us. We reserve the right to refuse to accept an order. All communications will be addressed to the email address you supply when you register

Before placing an order you can view and amend your order details at any time by clicking on the ‘Shopping Bag’.

Once you have placed an order for goods you will receive a ‘Confirmation Email’ that your order has been received (see below). This email will include a summary of the details of your order, which we would recommend that you print out and keep for your own records. The ‘Confirmation Email’ does not constitute our acceptance of your order; it merely records the fact that you have placed the order. Please check that all details in the ‘Confirmation Email’ are correct. If not, or if you do not receive a ‘Confirmation Email’ please contact us on  info@gerrardinternational.com

You may select items from our range of products, details of which will be added to the ‘Shopping Bag’ by clicking on the ‘Add to Bag’ button. By clicking on the ‘Checkout’ button in the ‘Shopping Bag’, you submit an offer to buy the goods in the ‘Shopping Bag’. We will send an email when we have packaged your goods which shall constitute our acceptance of your order (the ‘Acceptance Email’) at which point a binding contract of sale for products will be concluded between you and us. This email will also constitute our acceptance for the provision of delivery services. We will file a copy of any orders that are accepted by us.

 

Registering for a personal account

To make it easier for you to order products when using the Website, we offer you the opportunity to register for a personal account. If you take advantage of this opportunity any personal data that you provide us with as part of your account will be stored in our database and need not be entered with each new order; it will be entered into the order form automatically.

To register, you must supply us via the online registration form with the following information: your name, password and email address. Billing and delivery addresses can be added once registered. Once you click on the ‘Create an Account’ or ‘Save Address’ button this information will be stored in our customer database. You can access, update or correct your personal account details via the ‘My Account’ button. We will only use the stored data in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your password and account details and are responsible for all activities that are carried out under them. We do not have the means to check the identities of people using the Website and will not be responsible for losses suffered by you where your password or user name is used by someone else unless this is due to our negligence. Your use of the Website

By accepting the Terms you confirm that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and at all times.

You agree that in using the Website you will not: (i) use the Website in any way that causes, or is likely to cause the site or access to the site to be interrupted, damaged, or impaired in any way; (ii) use the Website for any purpose that could damage the name of beautylab.co.uk, BeautyLab London (and associated sub brands) or Gerrard International Limited or any goodwill attached to the Website; (iii) use the Website for criminal, fraudulent or illegal activity or in any manner which would cause harm or distress to any third party; (iv) access or attempt to access the accounts of other users or attempt to penetrate the Website security measures; nor (v) use the Website for any purpose other than your personal use.

We reserve the right to suspend, restrict or terminate your access to the Website at any time without notice if we have reasonable grounds to believe that you have breached any of these restrictions or if we suspect fraudulent account activity or behaviour. This shall not limit our right to take any other action against you that we consider appropriate.

Prices, Delivery Charges and Payment

The price of a product shall be as stated on this Website at the time you place your order except in the case of obvious error. We try and ensure that all prices on our Website are accurate but errors may occur. If we discover an error in the price of a product you have ordered, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will inform you of the correct price to you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel payment will be refunded to the card used to make payment.

We are proud to offer free delivery on all orders of £40.00 and over. Dependent on parcel size, weight, content and destination, delivery is made by DPD or a suitable courier partner.

We accept payment by debit or credit card and PayPal only. Payment will be debited from your account at the time of or shortly after you have placed your order.

You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. Fraudulent use of credit cards will be reported to the relevant authorities. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be responsible for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal.

We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

Promotion Codes

From time to time we issue Promotion Codes. We have a Promotion Code box situated at the “View Bag” page where codes can be entered. You must take care when entering codes as they are case and space sensitive. You may only redeem one code at a time so we advise you to choose the promotion best suited to your purchase. Unless stated Promotion Codes cannot be used in conjunction with any other offer including sale items. Please note that exclusions may apply. Please read the terms of each promotion carefully.

Our Legal obligations and our Limitation on Liability

You have certain rights under the law. These include that any products supplied by us will be of satisfactory quality and fit for their intended purpose. Nothing in these Terms is intended to affect these statutory rights. For more information about Your statutory rights contact Your local Citizens Advice Bureau or Trading Standards Office.

If we breach these Terms we shall only be liable for losses which are a reasonably foreseeable consequence of such a breach, up to a maximum of the purchase price of your order. Losses are foreseeable where they could be contemplated by you and us at the time of entering into this agreement.

Information provided about the products on the Website is intended to be used for educational or informational purposes only. While product images have been created to be an accurate-as-possible colour representation, they may not be 100% true to the actual product and should be used as an indication only.

The statements and products are not intended to diagnose, treat, cure or prevent any condition or disease. Please consult with your own doctor or health care practitioner regarding the suggestions and recommendations made on the Website.

With current technology it is not possible to develop and operate computer programs (software) and data processing systems (hardware) entirely without error, or to rule out any unpredictable events in connection with the internet. We provide no guarantee for the constant and uninterrupted availability of the Website.

We are not responsible for:

Losses not caused by our breach; indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time of entering into this agreement, for example loss of profits or loss of opportunity; failure to provide the Website or to meet any of our obligations under this agreement where such failure is due to Events Beyond Our Control.

“Events Beyond Our Control” means any cause beyond our reasonable control which prevents us from providing the Website or fulfilling any of our other obligations under this agreement and includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.

Copyright and Other Intellectual Property Rights

Your use of the Website grants no rights to you in relation to copyright, design rights, trade marks or other of our intellectual property rights (or the intellectual property rights of third parties).

We provide the Website to you solely for your personal, non-commercial use. You may electronically copy and print only those areas of the Website which are required in the process of using the Website as a shopping resource. The content of the Website may not be used for any other purpose without our express written permission.

Reviews

The review feature is available on the understanding that product reviews will be posted in good faith based on a user having trialled a product, to offer a helpful and truthful opinion of the product. All reviews are subject to approval and by submitting a review, it is not guaranteed to appear on the website.

If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You grant Gerrard International Limited the right to use the name and any image that you submit in connection with such content, if they choose.

You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

You agree to perform all further acts necessary to perfect any of the above rights granted by you to Gerrard International Limited, including the execution of deeds and documents, at the request of Gerrard International Limited.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Gerrard International Limited:

The content and material is accurate;
Use of the content and material you supply does not breach any applicable beautylab.co.uk guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Gerrard International Limited for all claims brought by a third party against Gerrard International Limited arising out of or in connection with a breach of any of these warranties.

Winners of any review competition will be notified by email. Failure to respond to our notification email within 20 days will result in the prize being forfeit.

VIP SPA/SALON AFFILIATE SCHEME

The BeautyLab VIP scheme, loyalty card and benefits are operated by Gerrard International for UK Spas and Salons only. Gerrard International can cancel, withdraw or alter the scheme at any time, including these terms and conditions or any individual VIP account. The UK BeautyLab VIP scheme is only valid on beautylab.co.uk. The BeautyLab VIP scheme is for personal use only for UK customers; business use is strictly prohibited and constitutes abuse. Gerrard International reserves the right, at point of purchase or retrospectively, to determine whether a transaction constitutes business usage. Gerrard International can take any action it considers appropriate, including removing or suspending a BeautyLab VIP account and any benefits accrued if we have reason to believe you are abusing the scheme. Discount does not apply to any other offers or special priced sets. Any products purchased from beautylab.co.uk will need to be returned to beautylab.co.uk. Items ordered from the website cannot be returned back to the Salon or Spa. Unique discount code needs to be entered at the checkout every time an order is placed online at beautylab.co.uk otherwise discount will not be credited. Delivery & Returns

Shipping terms

Items purchased through this website are for UK shipping only.

*We currently cannot deliver products to Belgium, Cyprus, Egypt, France, Germany, Lithuania, Luxembourg, Mauritius, Morocco, Poland, Reunion, Serbia, Sudan, Switzerland, United States & Canada.
Also note that we cannot deliver our ‘Black Diamond’ products to India, Russia and a few selected countries – please enquire before attempting a purchase”.

Gerrard International processes most orders received before 1pm the same working day, Monday through Friday, excluding holidays, subject to your payment being processed and stock availability. Orders placed after 1pm, on Saturday or Sunday or on a bank holiday will be processed the following working day.

While we will endeavour to have your products to you as quickly as possible, please allow 5 working days from placing your order to receipt of goods for orders with a UK delivery address. International orders may be subject to slightly longer shipping times.

During the COVID-19 outbreak, delivery times may be longer than usual.

All purchases are subject to bank or credit card authorisation and approval prior to processing. For your security, your billing name and address must match that of the credit card used for payment. We reserve the right to cancel any order that does meet these criteria.

RETURNS POLICY

We hope you are delighted with your online order. If for some reason you are not entirely satisfied, you may return the item in its original, pristine condition along with your proof of purchase within 30 days from the date you receive the goods for a full refund to your original payment method.

Only items purchased on beautylab.co.uk may be accepted for return or exchange. When items are purchased as a set, we are only able to accept returns of complete sets, not individual items.

If you are returning an item for a reason other than damaged, faulty or incorrect product, you will have the responsibility for covering the costs of the return. We recommend the goods are adequately packed for protection and that you ship using an insured, trackable service to ensure safe and prompt return. Please retain the copy of your proof of postage when you return the goods to us. In the unlikely event we do not receive the returned parcel, carriers require that you file the tracer or claim. We cannot be held responsible for returns lost in transit.

If the product delivered is not what you ordered, is damaged or of an unsatisfactory quality, we will supply a replacement product or refund the price paid and a reasonable cost for returning the product.

How To Return An Order

Please contact Customer Services on +44 (0) 345 217 1360 (Monday-Friday, 9am-5.30pm) or email info@gerrardinternational.com with your order number, the item(s) you want to return and the reason for return. Customer Services will supply a Returns Form that you will need to complete and include alongside the products and your original packing slip or invoice for return.

Please ensure the goods are adequately packed for protection and that you ship using an insured, trackable service for safe and prompt return. You will need to obtain a proof of postage for the rare event that your return is lost in transit. We are not responsible for returned articles until they reach our warehouse. Please note that if you fail to take reasonable care of returned products, or fail to return the product to us, we will be entitled to make a deduction from the refund for any loss in value.

Cancelling An Order

If you have made a purchase with us online, you have a statutory right to cancel your contract of sale within 14 days from the day you received the delivery and obtain a full refund. As we are committed to getting your order to you as quickly as possible, in most circumstances, we may not be able to amend or cancel an order once the status of an order has changed to ‘processing’. If you have made an error, please call us as soon as possible after placing the order on +44 (0) 345 217 1360 or by contacting us via email info@gerrardinternational.com. If your order has already been shipped, you will need to return the item(s) following our Returns Process in the event of any unwanted products. Please ensure that any unwanted goods are returned in their original, pristine condition.

If you choose to cancel/return your order within 14 days from delivery, we will refund you in full including the original cost of delivery. You will have the responsibility for covering the costs of the return for unwanted goods.

Missing, Incorrect or Incomplete Orders

We take the utmost care in preparing your order but in the event you receive an incomplete, incorrect or damaged order, please contact Customer Services on +44 (0) 345 217 1360 (Monday-Friday, 9am-5.30pm) or email info@gerrardinternational.com detailing your order number and the product details. If your package arrived damaged please keep the box, packing materials including the delivery note/invoice number, for inspection.

Refunds

Please allow 14 working days from the date we received your returned goods back to our warehouse for your refund to be processed. The refund will be made to the original payment method used to place the order. We will refund the price paid for the goods along with the original delivery costs (if applicable). We will not refund postage costs for returning any unwanted products. If you are returning damaged, faulty or incorrect items we will happily refund a reasonable cost for returning the products back to us. We may make a deduction from the refund if the goods have not been returned in their original, pristine condition or if reasonable care has not been made to protect the returned goods from damage. In such circumstances, we shall notify you of the reduced amount due to be refunded.

Order Cancellations

Occasionally, orders or parts of an order are cancelled by our system for various reasons, which may include:

Items are not available, difficulty in processing payment information, cannot ship to the address which was provided, duplicate order was placed, customer request for cancellation

If your order is cancelled, you will receive an email notice alerting you to the cancellation. You will not be billed for any cancelled items.
